Terms of Use

1. Acceptance

These Terms of Use ("Terms") govern your use of YomiAI ("the App"), provided by ZAWA SYSTEM ("the Operator"). By using the App, you agree to these Terms. If you do not agree to these Terms, please do not use the App.

2. Account

Use of the App requires sign-in with a Google account or an Apple account.

• You are responsible for using accurate account information
• You must not share your authentication credentials with any third party
• If you discover unauthorized use of your account, please contact the Operator promptly
• You may delete your data on the server and discontinue use of your account at any time using the "Delete user data" feature in the Settings screen

3. Service Description

The App is a news reader for subscribing to and reading RSS / Atom feeds. It provides:

• Registration, management, and reading of RSS / Atom feeds
• Offline saving and bookmarking of articles
• Categorization of feeds
• Full-text article search (on-device, offline)
• On-device translation (Apple Translation API on iOS 18+, Google ML Kit Translation on Android; processed entirely on the device with no transmission to our servers)
• Daily local notifications (scheduled on-device; no server-side push)
• Category lock via biometric authentication
• AI-based recommendations of feeds and articles (Pro plan only)
• AI-based automatic categorization of feeds (Pro plan only)
• AI-generated 3-bullet article summaries (Pro plan only)
• Daily digest: clustering of the past 24 hours of subscribed-feed articles into 3-5 topics by AI, with 30-day history (Pro plan only)
• Home-screen widgets displaying the latest articles and AI-recommended articles (Pro plan only)
• OPML import and export of feeds (Pro plan only)

4. Pricing Plans

The App offers a free plan ("Free") and a paid plan ("Pro").

5. Subscriptions

• The Pro plan is offered as a monthly subscription (JPY 200/month) or an annual subscription (JPY 2,000/year). Prices may change. Any price change applies to new subscriptions and to renewals on or after the effective date; for existing subscribers, the prior price remains in effect through the end of the current billing period. Price changes will be announced reasonably in advance via in-app notification or by updating this page.
• Payments are processed through the Apple App Store or the Google Play Store and are subject to each platform's terms. The Operator does not directly obtain or retain payment information such as credit card details.
• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
• To cancel auto-renewal, please use the subscription management screen of the App Store or Google Play Store on your device.
• Even after cancellation, you may continue to use Pro features until the end of the current billing period.
• In-app purchases are deemed mail-order sales (provision of electronic services) and are not subject to cooling-off under the Japanese Specified Commercial Transactions Act. Refunds follow the policies of Apple or Google.
• Where a free trial period is offered, you will be automatically transitioned to a paid subscription at the end of the trial unless you cancel beforehand.

6. Advertising

The Free plan displays advertisements (banner and medium-rectangle) provided by Google AdMob. The Pro plan does not display any advertisements. 7. AI Features

• The App's AI features (feed and article recommendations, automatic feed categorization, AI 3-bullet article summary, and the daily digest) are all exclusive to the Pro plan.
• AI recommendations are generated based on the interest tags you select in the Settings screen or the onboarding screen, together with an interest profile that is automatically constructed from your reading history.
• Automatic categorization, when invoked by you, generates category assignments from the titles and other metadata of your uncategorized feeds.
• The AI 3-bullet summary, when triggered by you from the article detail screen, sends the article title and body to generate up to three bullet points. Results are not stored on the operator's servers and are kept only ephemerally on your device.
• The daily digest, when you open the digest screen or tap "Generate now," uses the URLs and metadata of articles from your subscribed feeds within the past 24 hours to produce 3-5 clustered topics, which are retained for a defined period (30-day history).
• The Operator does not warrant the accuracy, completeness, or appropriateness of AI-generated recommendations, classifications, summaries, or digests, which are provided for reference only. The final decision to adopt them rests with you.
• AI features use Gemini on Google Cloud Vertex AI via Cloud Functions and are subject to the Google Cloud Service Specific Terms and the Vertex AI generative AI data governance policy. Google Cloud does not use customer data sent to Vertex AI to train its generative AI models.
• If you do not wish to have an interest profile constructed for AI recommendations, you may delete your interest profile and reading history at any time using the "Reset interest profile" feature on the Interest Profile screen, accessible from the Recommendations screen.

8. On-Device Translation

The App provides on-device translation of article body, title, and related text on the article detail screen. Translation is performed by Apple's Translation API on iOS 18 or later and by Google's ML Kit Translation on Android, and all processing is completed on your device. The text to be translated is never sent to the Operator or to our Cloud Functions. On Android, the first use of ML Kit Translation may download a language pack from Google's servers to your device, and such download is subject to Google's terms.

9. Content

• The App displays content from external sites via RSS / Atom feeds. The Operator does not create, control, or warrant such content.
• Copyrights in each feed and article belong to the respective content provider.
• The Operator is not responsible for damages arising from external content accessed through the feeds.

10. Prohibited Activities

You must not:

• Engage in conduct that violates laws or public order and morals
• Misuse the App, reverse-engineer, decompile, disassemble, or use automated tools to issue large volumes of requests
• Circumvent rate limits or bypass feature restrictions through unauthorized means
• Acquire or use subscriptions through fraudulent means
• Interfere with the App's servers or operations (e.g., excessive access, unauthorized access)
• Infringe the rights of the Operator or any third party
• Use the App for commercial purposes without prior permission of the Operator
• Engage in any other conduct that the Operator reasonably deems inappropriate

11. Disclaimer

The App is provided on an "as is" basis. Features such as feed retrieval, article display, recommendation, and classification have inherent limits, and the Operator makes no express or implied warranties as to the completeness, accuracy, reliability, or fitness for a particular purpose of the App.

Except where prohibited by applicable law, the Operator shall not be liable for any damages (including, without limitation, loss of data, loss of opportunity, or secondary harm) arising from use of, inability to use, external site content, or third-party services (Firebase, RevenueCat, Google AdMob, Google Cloud (including Vertex AI), etc.). This limitation does not apply where the damage is caused by the Operator's willful misconduct or gross negligence, or where the limitation is invalidated in whole or in part by mandatory consumer protection laws (including Article 8 of the Japanese Consumer Contract Act).

Where the Operator is liable under applicable law or these Terms, except in the cases set forth in the preceding paragraph (including the Operator's willful misconduct or gross negligence, and cases where this paragraph is invalidated in whole or in part by mandatory consumer protection laws), such liability shall be limited to ordinary damages (excluding lost profits and damages arising from special circumstances) and shall not exceed the total amount paid by the user to the Operator in connection with the App during the twelve (12) months preceding the event giving rise to the claim (JPY 1,000 for users on the free tier).

12. Intellectual Property

Intellectual property rights in the design, logo, source code, and other content created by the Operator for the App belong to the Operator or the rightful owner. You must not reproduce, modify, or redistribute such content without the prior consent of the Operator.

13. Account Suspension and Deletion

If you violate these Terms, or if the Operator reasonably determines that suspension is necessary for the safe operation of the App, the Operator may suspend the account or delete the user's data without prior notice.

14. Changes to and Discontinuation of the Service

The Operator may modify, add, remove, suspend, or discontinue the App at any time without prior notice. Some features may become unavailable due to changes in third-party services such as Firebase, RevenueCat, or Google Cloud (including Vertex AI). If the App is discontinued, the Operator will give reasonable advance notice and will, where practicable, offer a means to export user data.

15. Changes to Terms

These Terms constitute standard terms of contract (teikei-yakkan) under Article 548-2 paragraph 1 of the Japanese Civil Code, intended to provide the App to many users on uniform conditions. The Operator may amend these Terms in accordance with Article 548-4 of the Japanese Civil Code only where (i) the amendment conforms to the general interest of users, or (ii) the amendment does not contradict the purpose of the App and is reasonable in light of the necessity of the change, the appropriateness of the amended terms, the fact that this section anticipates such amendments, and other relevant circumstances.

Material changes will be announced reasonably in advance through in-app notification or by updating this page, together with the content of the amended Terms and the effective date. Minor changes take effect upon posting on this page. If you continue to use the App after the effective date of the changes, you are deemed to have agreed to the amended Terms.

16. Privacy

For the handling of personal information, please refer to the Privacy Policy. By agreeing to these Terms, you also consent to the collection, use, and third-party sharing of information described in the Privacy Policy.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan. Any disputes arising in connection with the App shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
